Processing of personal data The processing of personal data is carried out in accordance with the general principles set out in the &#8220;GDPR&#8221;, namely: <\/p><p> <\/p><ol><li>In the context of the relationship established with the data subject, we ensure that personal data will be processed lawfully, fairly and transparently (&#8220;Principle of lawfulness, fairness and transparency&#8221;);<\/li><li>We collect personal data for specified, explicit and legitimate purposes and do not subsequently process such data in a manner incompatible with those purposes (&#8220;Principle of purpose limitation&#8221;);<\/li><li>We ensure that only personal data that is adequate, relevant and limited to what is strictly necessary for the purposes for which it is processed is processed (&#8220;Principle of data minimization&#8221;);<\/li><li>We adopt appropriate measures to ensure that inaccurate personal data, taking into account the purposes for which it is processed, is erased or rectified without delay (&#8220;Principle of accuracy&#8221;); <\/li><li>We retain personal data in a form that permits identification only for as long as necessary for the purposes for which it is processed (&#8220;Principle of storage limitation&#8221;); <\/li><li>We ensure that personal data is processed in a manner that ensures its security, including protection against unauthorized or unlawful processing and against accidental loss, destruction or damage, by adopting appropriate technical or organizational measures (&#8220;Principle of integrity and confidentiality&#8221;).<\/li><\/ol><p> <\/p><h2 class=\"wp-block-heading\"><strong>What personal data we process <\/strong><\/h2><p> <\/p><p>In the context of the activities carried out by the Company, the data subject is, without limitation, the customer and\/or former customers, potential customers, investors, partners, job applicants, employees and former employees, employees of partners, suppliers and service providers and their employees, applicants and complainants, visitors and individuals and all those individual persons who maintain a relationship with the Company and to whom the personal data relates. <\/p><p> <\/p><p>In the course of its activities, LIDERLINK Business Solutions processes personal data from a significant number of categories of data subjects. <\/p><p> <\/p><p>The personal data that LIDERLINK Business Solutions collects always depends on the nature of the interaction, but may include the following: <\/p><p> <\/p><ol><li>Identification and contact data: Name, surname, postal address, telephone number, mobile phone, email address.<\/li><li>Data related to the provision of services, or for contractual performance or for compliance with legal obligations, such as: property data, billing data, billing history, current account balances, payment data and signature.<\/li><li>Data related to the method of acquisition or subscription of services, their transaction, billing history and assistance in the context of the Company&#8217;s services that you use, or any other related information and information in the context of responding to any questions, requests or complaints. <\/li><li>Security credentials data: User identification, passwords and similar security information necessary for authentication and access to Company accounts.<\/li><li>Preference data: Information about the holder&#8217;s preferences and interests, to the extent that this is related to the services and about how they prefer to receive communications.<\/li><li>Social media data: Public information shared on social media in interaction with the Company, where transparency is ensured through the existence of appropriate privacy policies.<\/li><li>IT usage data: User ID, roles, rights, login times, computer name, IP address.<\/li><li>Depending on the relevant circumstances and applicable local laws and requirements, we may collect: photograph, video image, age\/date of birth, diversity information and supplementary information that you choose to share with us.<\/li><li>CCTV system images, if you visit our premises.<\/li><\/ol><p> <\/p><p>We note that you will not be required to share personal data with the Company. However, the Company may be required to retain some personal data for a longer period, taking into account factors such as:  <\/p><p> <\/p><ol><li>Legal obligations, under applicable laws, to retain personal data for a certain period;<\/li><li>Limitation periods, under applicable laws;<\/li><li>Litigation;<\/li><li>Guidelines issued by competent supervisory authorities. <\/li><\/ol><p> <\/p><h2 class=\"wp-block-heading\"><strong>Sharing personal data with third parties <\/strong><\/h2><p> <\/p><p>Personal data may be shared with entities responsible for providing services to LIDERLINK Business Solutions. <\/p><p> <\/p><p>In compliance with legal and\/or contractual obligations, personal data may also be transmitted to judicial, administrative, supervisory or regulatory authorities and also to entities that lawfully carry out data compilation actions, fraud prevention and combating actions, statistical studies, namely:<\/p><p> <\/p><ol><li>Public authorities, such as Tax Authorities, Banco de Portugal, Judicial or Administrative Courts, Notary Offices and Land Registry Offices, Municipalities, Parish Councils, Directorate-General for Territory, Directorate-General for Cultural Heritage, Social Security;<\/li><li>Service providers who provide services to the Company within the scope of the business function. <\/li><\/ol><p> <\/p><h2 class=\"wp-block-heading\"><strong>Cross-border EEA data transfer <\/strong><\/h2><p> <\/p><p>In the context of the internationalization of the provision of integrated services to Clients, or to our international partners, or to external communications service providers or to external service providers in the area of information systems management, LIDERLINK Business Solutions may transfer personal data outside the European Economic Area (EEA), such as Portuguese-speaking countries, whose data protection legislation may not ensure protection equivalent to that provided within the EEA. However, the Company only transfers personal data outside the EEA: <\/p><p> <\/p><ol><li>When the transfer is made to a location or through a method or in circumstances that the European Commission considers to ensure adequate protection of personal data;<\/li><li>When it has implemented standard data protection clauses adopted by the European Commission or by a competent data protection authority;<\/li><li>When none of the above options apply, but the law still authorizes such transfer, for example, if it is necessary for the declaration, exercise or defense of a right in legal proceedings. <\/li><\/ol><p> <\/p><p>In this regard, the Company follows criteria in the selection of service providers, in order to comply with its obligations to protect personal data, committing to enter into a Data Processing Agreement with them, which includes, among others, the following obligations to apply appropriate technical and organizational measures to protect personal data. <\/p><p> <\/p><h2 class=\"wp-block-heading\"><strong>What are the rights of the data subject <\/strong><\/h2><p> <\/p><p>As a data subject whose personal data is processed by LIDERLINK Business Solutions, you have the right of access, rectification, restriction, portability, erasure and the right to object to the processing of personal data, in certain circumstances, which may be exercised in accordance with this chapter of the Privacy Policy. <\/p><p> <\/p><ol><li>Right to be informed<ol><li>You have the right to obtain clear, transparent and easily understandable information about how the Company uses personal data and what your rights are. That is why the Company provides all this information in this Privacy Policy. <\/li><\/ol><\/li><li>Right of access<ol><li>You have the right to obtain information about what personal data the Company processes (if it is processing it) and certain information (similar to that provided in this Privacy Policy) about how that data is processed. This right allows you to know and confirm that we use your data in accordance with data protection laws. The Company may refuse to provide the requested information whenever, in order to do so, the Company would have to disclose personal data of another person or that the information negatively impacts the rights of another person.  <\/li><\/ol><\/li><li>Right to rectification<ol><li>If your data is incorrect or incomplete (for example, if your name or address is wrong), you may ask the Company to take reasonable steps to correct it. \u2022 Right to erasure of personal data This right is also known as the &#8220;right to be forgotten&#8221; and, simply put, allows you to request the erasure or deletion of your data, provided there are no valid grounds for the Company to continue using it or its use is unlawful. This is not a general right to erasure, as exceptions are admitted (for example, whenever such data is necessary for the defense of a right in legal proceedings).  <\/li><\/ol><\/li><li>Right to restriction of processing<ol><li>You have the right to &#8220;block&#8221; or prevent future use of data while the Company evaluates a rectification request or as an alternative to erasure. Whenever processing is restricted, the Company may continue to store the data, but may not use it subsequently. The Company maintains a list of data subjects who have requested the &#8220;blocking&#8221; of future use of their data to ensure that this restriction is respected.  <\/li><\/ol><\/li><li>Right to data portability<ol><li>You have the right to obtain and reuse certain personal data for your own purposes across various organizations. This right applies only to your own data that you have provided to the Company and that the Company processes with your consent and that is processed by automated means. <\/li><\/ol><\/li><li>Right to object<ol><li>You have the right to object to certain types of processing, for reasons related to your particular situation, at any time during such processing, for the purposes of the legitimate interest of the Company or third parties. The Company may continue to process such data if it can demonstrate &#8220;compelling legitimate grounds for the processing which override your interests, rights and freedoms&#8221; or if such data is necessary for the establishment, exercise or defense of a right in legal proceedings. <\/li><\/ol><\/li><li>Right to withdraw consent<ol><li>When the legal basis is consent, you have the right to withdraw it at any time. <\/li><\/ol><\/li><li>Right to lodge a complaint<ol><li>You have the right to lodge a complaint with the competent supervisory authority, the National Data Protection Commission \u2013 CNPD, if you consider that the processing of personal data violates your rights and\/or applicable data protection laws. You may do so through the website www.cnpd.pt.  <\/li><\/ol><\/li><\/ol><p> <\/p><h2 class=\"wp-block-heading\"><strong>Security and confidentiality <\/strong><\/h2><p> <\/p><p>Personal data will be processed by LIDERLINK Business Solutions, in the context of the purposes identified in this Policy, in accordance with other policies, procedures and internal standards of the Company and using appropriate technical and organizational measures to promote their availability, confidentiality and integrity, namely in relation to unauthorized or unlawful processing of personal data and their accidental loss, destruction or damage. Without limitation, LIDERLINK Business Solutions uses logical and physical security requirements and measures to ensure the protection of personal data through the prevention of unauthorized access, ensures that information storage is done on secure computers in a closed and certified data center and that data is encrypted whenever possible, has implemented audit and control procedures to ensure compliance with security and privacy policies and periodically reviews our security policies and procedures to ensure that the Company&#8217;s systems are secure and protected. However, since the transmission of information over the Internet is not completely secure, the Company cannot guarantee the security of data when transmitted over an open network.   <\/p><p> <\/p><h2 class=\"wp-block-heading\"><strong>Use of cookies <\/strong><\/h2><p> <\/p><p>LIDERLINK Business Solutions automatically collects information whenever someone visits the Websites. The Company obtains information from the user&#8217;s computer and assigns them a &#8220;cookie&#8221; (small package of information about that user) when someone visits its Website.  <\/p><p> <\/p><p>This data is not provided by the user \u2013 it is collected automatically as a means of facilitating connections to the Websites and their use.
